The tailgate on M38 was only bolted shut when not in use. The spare tire carrier on M38 is two piece. The top can be removed and relocated to passenger side like the CJ3A. If you look at passenger side of OE M38 tub you will see four dimples for locating the tire carrier holes.� We used our M38 tailgates on a regular basis to draw ammo, carry heavy weapons and etc.� move tire carrier and tire to side, strap can somewhere, strap top back panel to forward bow and use straps in lieu of chains. You can make the change pretty quick.

As I pointed out earlier, your jeep appears to be M38. From the the photo your tub and frame have M38 features.
